What is the current status of the state militia? What type of organization and equipment do they have?

Generally whatever the citizen members of militias can provide for themselves.

Esteemed Delegates,

Virginia has spent many years on the front lines of innovation in the way of battle. I myself served in the Virginia Regulars and with President Washington himself. Despite this, our borders are always at risk of Indian attack and our militias are only managing the problem not dealing with it. I propose the following legislation to help solve that problem. I urge the General Assembly to consider this legislation with great clarity. I know as Virginian's that you will do just that. Mr. Owens of Norfolk, for himself, introduced,

A BILL,

An Act forming a uniformed State Guard.

Be it enacted by the Senate and House of Delegates of Virginia in the General Assembly assembled,

Section 1. - Title

 (A) This act shall be titled the Virginia State Guard Act

Section 2. - Definition

(A) State Guard - A Commonwealth Guard shall be the regular permanent standing guard of the Commonwealth of Virginia.

(B) State Guard Militia - A reserve force comprising of the various militia forces around the Commonwealth of Virginia.

Section 3. - Membership

(A) State Guard

(1) Must be a citizen of the Commonwealth of Virginia.

(2) Must be free-men.

(3) Must be at least 12 years old or above.

(4) Must be of abled body and mind.

(5) Must meet additional eligibility criteria as laid out by the Virginia State Guard Bureau.

(B) State Guard Militia

(1) Must be a citizen of the Commonwealth of Virginia.

(2) Must be free-men.

(3) Must be at least 12 years old or above.

(4) Must meet additional eligibility criteria as laid out by the Virginia State Guard Bureau Militia Division.

Section 4. - Organizational Leadership

(A) The Virginia State Guard Organizational Structure shall follow that of any Uniformed Armed Services Group.

(B) The Commander in Chief of the Virginia State Guard is the Governor of the Commonwealth of Virginia.

(C) The Virginia State Guard Rank Structure shall be as follows -

(1) Commissioned Officers -

(a) Major General

(b) Brigadier General

(c) Colonel

(d) Lieutenant Colonel

(e) Captain

(f) Lieutenant

(g) Ensign

(2) Non-Commissioned Officers and Enlisted Ranks -

(a) Sergeant Major

(b) Sergeant

(c) Corporal

(d) Private

(e) Recruit

(D) Virginia State Guard Militia Structure shall be as follows -

(1) Commissioned Officers -

(a) Militia Colonel

(b) Militia Lieutenant Colonel

(c) Militia Captain

(d) Militia Lieutenant

(e) Militia Ensign

(2) Non-Commissioned Officers and Enlisted Ranks -

(a) Militia Sergeant Major

(b) Militia Sergeant

(c) Militia Corporal

(d) Militia Private

(e) Militia Recruit

(E) The Virginia State Guard Bureau is established under the Office of the Governor of Virginia.

(3) The Governor shall appoint the Major General who is most senior enlisted member and commander of the Virginia State Guard.

(a) The Major General shall appoint the Brigadier General of each Division

(2) Under the State Guard Bureau there shall be several Divisions such as the - 

(a) Procurement Division

(I) Shall be responsible for procurement of all equipment and supplies for the Virginia State Guard.

(II) Shall be commanded by a Brigadier General.

(b) Operations Division

(I) Shall be responsible for the general internal operations of all State Guard units.

(II) Shall be commanded by a Brigadier General.

(c) Recruitment Division

(I) Shall be responsible for the recruitment of State Guard units.

(II) Shall be commanded by a Brigadier General.

(d) Training Division

(I) Shall be responsible for the training of State Guard units.

(II) Shall be commanded by a Brigadier General. 

(e) Militia Division

(I) Shall be responsible for the procurement of all equipment and supplies, operation, recruitment, and training of all State Guard Militia units.

(II) Shall be commanded by a Militia Colonel.

(3) There shall be a general fund for the Virginia State Guard Bureau that shall be filled by the annual budget process.

Section 5. - Advancement and Progression

(A) Rank advancement and progression shall follow the Uniformed Armed Services Guidelines.

Section 6. - Court Martial Guidelines

(A) In the event of a Court Martial-able offense the Major General of the Virginia State Guard shall establish a three judge panel made up of three senior officers.

Section 7. - Term of Service

(A) The Virginia State Guard Term of Service Schedule shall be as follows, officers, non-commissioned officers, and enlisted may enroll in unlimited number of terms provided they meet the eligibility criteria -

(1) Commissioned Officers

(a) Four Year Term

(b) Eight Year Term

(c) Twelve Year Term

(2) Non-Commissioned Officers and Enlisted

(a) Two Year Term

(b) Four Year Term

(c) Six Year Term

(d) Eight Year Term

Section 8 - Establishment of the Virginia State Military Academy

(A) The Virginia State Guard Bureau shall establish the Virginia State Military Academy.

(1) Payment for construction and operation of the Academy shall be funded through donor endowment.

(2) Dean of the Academy shall be appointed by the Major General of the Virginia State Guard.

(3) Once established the officers of the Virginia State Guard shall come from the Academy.
